Benton County Superior Court Records

Benton County Superior Court cases are managed by the Superior Court Clerk. The clerk's office is at 7122 W. Okanogan Place, Suite A210, Kennewick, WA 99336. Court records at the Superior Court level are governed by Washington Court Rules GR 31 and GR 31.1, not the Public Records Act. The court has its own public records portal described at bentonwa.org/Court_Records.html. Research fees are $20 per hour. Certified copies cost $5 for the first page and $1 for each additional page. Non-certified paper copies are $0.50 per page. Emailed non-certified copies are $0.25 per page. Court recordings cost $10 per CD or thumb drive plus the research fee.

Benton County has two District Court locations. One serves Kennewick and one serves Prosser. District courts handle misdemeanor criminal cases, traffic matters, civil cases up to $100,000, protection orders, and small claims. Superior Court records are generally kept permanently, while closed District Court records are retained for three years. Domestic violence and DWI cases are retained for 10 years.

Restricted records in Benton County courts include police reports filed with the court, mental health commitment records, alcohol and drug treatment commitment records, and sealed court records. These are not available to the public regardless of the request method.

The Benton County Sheriff's Office has its own dedicated NextRequest portal at bcsobccd.nextrequest.com. Use this portal for incident reports, arrest records, body camera footage, and other law enforcement records. Sheriff's records are handled separately from general county records and may have different processing times.

Some law enforcement records are exempt from disclosure under RCW 42.56.240 when nondisclosure is essential to an active investigation. Collision reports may be available through the Washington State Patrol rather than the Sheriff. Be specific when submitting a request. Include dates, incident numbers, and names to help the records coordinator find the right documents.
